Understand the numbers

A contingency agreement can define which amount the fee applies to and how expenses and reimbursements are handled. This worksheet makes those choices visible so you can ask better questions before signing.

Enter your own figures

Read the agreement before entering a percentage

Use the percentage and calculation method in the agreement offered by the lawyer. A contingency fee may change at different stages of a case, and the agreement should explain how case expenses are handled. The calculator offers only two simplified ways to apply a percentage. It cannot interpret a contract, decide whether a charge is permitted, or determine the amount of any medical lien.

In Texas, Government Code §82.065 requires a contingent fee contract for legal services to be in writing and signed by the attorney and client. Read the written agreement and ask questions before signing. Our contingency fee guide explains common terms.

Example: the fee basis changes the illustration

Assume a hypothetical $100,000 gross recovery, a 30% fee, $5,000 in case expenses, and $10,000 in liens. A fee calculated on the gross amount would be $30,000; after the entered expenses and liens, the illustrative balance is $55,000. If the same 30% were applied after deducting the $5,000 in expenses, the fee would be $28,500 and the illustrative balance $56,500. That $1,500 difference comes entirely from the chosen fee basis. Neither number is a promised payment, and your agreement may use other terms.

Check every deduction before relying on a net figure

Ask the lawyer for a proposed disbursement statement identifying the gross recovery, attorney fee, itemized case expenses, and any liens or reimbursement claims. Confirm whether expenses are deducted before or after the fee, who pays them if there is no recovery, and whether the percentage changes after a lawsuit or appeal. Medical balances and reimbursement claims may be negotiated or disputed; do not assume the amount entered here is final.

This tool is most useful after you have an actual offer or a concrete hypothetical gross amount. If you are still organizing possible accident losses, start with the Texas car accident worksheet. The pain and suffering explorer explains why a noneconomic figure should not be treated as a guaranteed part of a recovery.

Common questions

Is there one standard personal injury attorney fee?

No rate is built into this tool. Enter the percentage in the agreement you are considering; fees and terms can vary.

Does LawyerHelpNow set the lawyer's fee?

No. Submitting an inquiry is free. Hiring and legal fees are arranged directly with a lawyer, if you choose to work together.

Why could my actual check differ?

Case expenses, liens, reimbursement rights, contract terms, and other adjustments may differ from what you entered.
